Housing

On  6 April 2006, the Housing Health and Safety Rating System (HHSRS) was introduced under Part 1 of the new Housing Act 2004; to assess statutory minimum standards for all dwelling houses in England and Wales.

Whereas the previous Fitness Standard for dwellings, first introduced over 80 years ago, took a 'bricks and mortar' approach; HHSRS is an evidence-based risk assessment procedure, which takes a holistic health, safety and welfare approach.

The principle behind the rating system is that a dwelling; including the structure, associated outbuildings, garden, yard, and/ or other amenity space, should provide a safe and healthy environment for the occupants and any visitors. All landlords and owner occupiers have a duty to ensure that their properties comply with HHSRS requirements. We can carry out HHSRS assessments on behalf of landlords, agents and tenants. Noise

Sanctum Consultant provide a range of noise related services through Noisedirect; our dedicated noise service. We can carry out nuisance assessments, acoustic monitoring, and provide Home Buyers and Sellers Noise Reports. Nuisance

In principle, almost anything which stops anyone from exercising and enjoying their rights can be deemed a nuisance under common law. A private nuisance results from an unlawful interference with a person's use or enjoyment of their land or some right over or in connection with it. A statutory nuisance is an act or omission, which has been designated a nuisance under the Environmental Protection Act 1990. We carry out nuisance assessments for individuals affected by statutory or private nuisances. Our Section 82 Advice Pack enables anyone affected by a statutory nuisance to instigate low cost proceedings for the abatement of a nuisance in the Magistrates Court.

Legal

All our advice is provided in accordance with the statutory defined role of Environmental Health Professionals, for the assessment of conditions that can give rise to nuisance or impact on public health. We do not provide legal representation or act as advocates on behalf of any party. We do have experience of working with Solicitors and Barristers who are experienced in environmental and public law. We can on request provide a list of suitable advocates who you may choose to instruct through direct access to represent you at any hearing or legal action.

The Bar Council’s Bar Directory is the official directory of Barristers of the General Council of the Bar for England and Wales and can be used to find a suitably qualified and competent Barrister.

The Law Society for England and Wales provides a searchable database of solicitors including firms with the Law Society's Lexcel accreditation.  The directory can be used to find a suitable advocate to represent your interests
